These Terms of Service ("Terms") govern your use of the ByOwnerOregon.com website and flat fee MLS listing services provided by RealtyNet LLC ("we," "us," or "our"). By using our services, you agree to these Terms.

1. Services Overview

ByOwnerOregon.com provides flat fee MLS listing services for Oregon property sellers. Our services include:

  • Flat Fee MLS Listing: Entry of your property into the applicable Oregon MLS (RMLS, WVMLS, Oregon Data Share, or Oregon Coast MLS) for a one-time flat fee.
  • Agent Assist: MLS listing combined with broker guidance on pricing, offers, and negotiation.
  • Discount Full Service: Complete broker representation at a reduced commission rate.
  • Add-On Services: Optional services including professional photography, showing coordination, and additional MLS syndication.

All services are performed by licensed Oregon real estate brokers employed by or affiliated with RealtyNet LLC.

2. Eligibility & Account

  • You must be 18 years or older and legally authorized to sell the subject property.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • Information you provide must be accurate, complete, and current. You are responsible for updating your information promptly.
  • One account per individual. Account sharing is not permitted.

3. Listing Services & MLS Rules

Accuracy of Information

You are responsible for the accuracy of all property information, photos, and disclosures submitted for MLS listing. RealtyNet LLC enters information into the MLS as provided by you. Misrepresentation of property details may violate Oregon real estate law and MLS rules.

MLS Compliance

All listings must comply with the rules and regulations of the applicable MLS. This includes but is not limited to:

  • Accurate property descriptions and measurements
  • Appropriate photo quality and content standards
  • Timely status updates (pending, sold, withdrawn)
  • Required Oregon seller disclosures
  • Buyer agent compensation disclosure

We reserve the right to modify or remove listings that violate MLS rules or applicable law.

Listing Duration

Listing duration varies by package and MLS requirements. Standard listing periods are defined in your service agreement. Extensions or renewals may incur additional fees as outlined in your package terms.

4. Fees & Payment

  • Service fees are displayed on our pricing page and confirmed at checkout.
  • All fees are in U.S. dollars and are non-refundable once MLS entry has been initiated, except as required by law.
  • Payment is processed securely via Stripe. We do not store credit card information.
  • Additional services (photography, showing coordination, etc.) are billed separately as add-ons.
  • Buyer agent compensation offered through the MLS is set by you and is separate from our service fees.

5. Professional Photography Services

Professional photography services are available as part of select packages or as a standalone add-on purchase. The following terms apply to all professional photography services:

  • Service Area: Professional photography is included at no additional charge within 20 miles of our supported Oregon metro areas (Portland, Salem, Eugene, Bend, Medford, and Roseburg). Properties outside the included service area may be subject to a trip charge, which will be quoted and must be approved before scheduling.
  • Deliverables: A standard photography session includes 25 to 48 professionally edited photos, determined by the photographer based on the property. Edited photos are delivered within 48 business hours of the session.
  • Scheduling & Cancellation: Photography sessions are scheduled by our team in coordination with you. If you need to cancel or reschedule, at least 24 hours advance notice is required. A $150 rescheduling fee applies for no-shows, cancellations with less than 24 hours notice, or if the photographer arrives and the property is not in a condition to be photographed.
  • Seller Responsibilities: You are responsible for ensuring the property is accessible, clean, staged, and ready for photography at the scheduled time. All lights should be on, blinds and curtains open, pets secured, and vehicles cleared from the driveway.
  • Refund Policy: Photography fees are non-refundable except in the event that we are unable to locate a photographer who services your area. If a trip charge is declined or expires without response, photography will not be provided and no refund will be issued. Seller-initiated cancellation of photography services does not entitle the seller to a refund or credit.
  • Photo Usage: Photos taken during your session may be used by ByOwnerOregon for your property listing on the MLS, syndicated websites, and our marketing materials. You retain the right to use the photos for personal purposes related to the sale of your property.

6. Your Obligations as Seller

As a flat fee MLS client, you retain responsibility for:

  • Responding to showing requests and buyer inquiries in a timely manner
  • Completing required Oregon property disclosures accurately
  • Notifying us promptly of status changes (accepted offer, withdrawn, sold)
  • Complying with all applicable Oregon real estate laws and fair housing regulations
  • Maintaining property access and condition as represented in the listing
  • Working with your own legal and financial advisors for transaction guidance

7. Brokerage Relationship

The nature of our brokerage relationship depends on your selected service tier:

  • Flat Fee MLS: RealtyNet LLC acts as your listing brokerage for the limited purpose of MLS entry and syndication. This is a limited-service agency relationship.
  • Agent Assist: Enhanced brokerage relationship with guidance on pricing, offers, and negotiation in addition to MLS entry.
  • Discount Full Service: Full brokerage representation including property marketing, showings, negotiations, and closing coordination.

The specific terms of our brokerage relationship are detailed in the Oregon Real Estate Agency Disclosure Pamphlet and your listing agreement, provided during the onboarding process.

8. Intellectual Property

  • All website content, design, logos, and software are owned by RealtyNet LLC and protected by intellectual property laws.
  • You retain ownership of photos, documents, and property descriptions you submit. By submitting content, you grant us a license to use it for MLS listing, syndication, and marketing of your property.
  • MLS data displayed on our site is subject to the copyright and usage terms of the respective MLS organizations.

9. Prohibited Use

You agree not to:

  • Submit false, misleading, or fraudulent property information
  • Use our services for any unlawful purpose
  • Interfere with the operation of our website or services
  • Scrape, crawl, or automate data collection from our site beyond normal usage
  • Impersonate another person or misrepresent your authority to list a property
  • Violate fair housing laws in your listing content or buyer interactions

10. Limitation of Liability

To the maximum extent permitted by law:

  • RealtyNet LLC is not liable for indirect, incidental, consequential, or punitive damages arising from your use of our services.
  • Our total liability for any claim is limited to the fees you paid for the specific service giving rise to the claim.
  • We are not responsible for the actions of buyers, buyer agents, or other third parties involved in your real estate transaction.
  • We do not guarantee that your property will sell or sell at any particular price or within any timeframe.

11. Disclaimers

  • Our website and services are provided "as is" without warranties of any kind, express or implied.
  • We do not provide legal, tax, or financial advice. Consult appropriate professionals for such guidance.
  • Market data, savings estimates, and property valuations are approximations and should not be relied upon as guarantees.
  • MLS availability and syndication reach may vary and are subject to MLS rules and third-party website policies.

12. Termination

Either party may terminate the service relationship as follows:

  • By you: You may request listing withdrawal at any time through your seller portal or by contacting us. Fees already paid are non-refundable.
  • By us: We may terminate or suspend your account for violation of these Terms, MLS rules, or applicable law, with notice when practicable.

13. Governing Law

These Terms are governed by the laws of the State of Oregon. Any disputes arising from these Terms or our services shall be resolved in the courts of the State of Oregon.

14. Changes to These Terms

We may update these Terms periodically. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes constitutes acceptance of the revised Terms.
